Terms of Service

These Terms of Service govern your use of the Rewynd application and services operated by AI Call Assist Pty Ltd (ABN 22 696 284 456).

1. Acceptance of Terms

By accessing or using the Rewynd application, website, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms. We will notify you of material changes via email or in-app notification at least 14 days before they take effect.

2. Description of Service

Rewynd is a call recording, transcription, and action extraction service designed for business professionals. The Service:

  • Records inbound and outbound phone calls routed through your Rewynd number
  • Transcribes call audio using AI speech-to-text technology
  • Extracts action items, summaries, and key details from transcriptions using artificial intelligence
  • Delivers post-call summaries and action items to you via email and push notifications
  • Sends action-item emails to your callers on your behalf, where their email address is available (see section 4A)
  • Provides an AI receptionist to handle calls when you are unavailable
  • Deletes call audio within 24 hours of transcription — only text-based data is retained

3. Account Registration

To use the Service, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorised access to your account
  • Accept responsibility for all activity under your account

You must be at least 18 years old to create an account and use the Service.

4. Call Recording Consent and Compliance

Rewynd records phone calls routed through your Rewynd number in accordance with the Telecommunications (Interception and Access) Act 1979 (Cth). By using the Service, you acknowledge and agree that:

  • You are responsible for complying with all applicable laws regarding call recording in your jurisdiction, including obtaining any required consent from call participants
  • Call recording laws in Australia vary by state and territory. Some jurisdictions (including NSW, SA, and TAS) generally require the consent of all principal parties to a call. Other jurisdictions (including ACT, VIC, QLD, WA, and NT) generally permit one-party consent recording, with restrictions on disclosure
  • Rewynd plays a notification at the start of recorded calls to inform participants that the call may be recorded and summarised by AI
  • You must not use the Service to record calls where doing so would violate applicable law

Your Responsibility

We provide the recording notification as a convenience, but compliance with call recording laws is ultimately your responsibility. We recommend seeking independent legal advice regarding your obligations in your specific jurisdiction.

4A. Communications to Callers

Rewynd may send emails to your callers on your behalf, containing action items arising from a call. These emails are sent from [email protected] and identify you as the sender. By using this feature, you acknowledge and agree that:

  • You have a lawful basis to share your callers' contact details with us for the purpose of sending post-call action items
  • Callers may opt out of receiving emails at any time via the unsubscribe link included in every email
  • You must not attempt to circumvent a caller's opt-out or re-add opted-out email addresses
  • We comply with the Spam Act 2003 (Cth) in relation to all emails sent to callers

Caller emails contain only action items relevant to that caller. Full call transcripts and summaries are not shared with callers.

5. Subscription and Payment

Rewynd offers subscription plans with varying features and usage limits. By subscribing to a paid plan, you agree to:

  • Pay the applicable subscription fees as described at the time of purchase
  • Authorise recurring charges to your payment method at the start of each billing period
  • Accept that subscription fees are non-refundable except where required by Australian Consumer Law

We may change subscription pricing with 30 days' notice. Your continued use after a price change constitutes acceptance. Free trial periods, if offered, convert to paid subscriptions at the end of the trial unless cancelled.

Your subscription includes a monthly allocation of call minutes. Usage beyond your included minutes may require the purchase of additional minute packs. Payments are processed by Stripe. We do not store your credit card details.

Consumer Guarantees

Under the Australian Consumer Law, you may be entitled to a remedy (including a refund) if the Service has a major failure or cannot be remedied. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee under the Australian Consumer Law.

6. Acceptable Use

You agree not to use the Service to:

  • Record calls in violation of applicable law
  • Harass, threaten, or intimidate any person
  • Transmit malicious code or interfere with the Service's operation
  • Attempt to gain unauthorised access to the Service or other users' data
  • Use the Service for any illegal purpose
  • Resell, sublicense, or redistribute the Service without our written consent

We reserve the right to suspend or terminate your account for violations of these Terms.

7. Intellectual Property

The Service, including its design, code, features, and documentation, is owned by AI Call Assist Pty Ltd and protected by intellectual property laws. You retain ownership of your call data (recordings, transcriptions, action items) and grant us a limited licence to process this data solely to provide the Service.

You may not copy, modify, distribute, or reverse-engineer any part of the Service.

8. Data Breach Notification

In the event of an eligible data breach that is likely to result in serious harm to you, we will notify you and the Office of the Australian Information Commissioner (OAIC) as required under Part IIIC of the Privacy Act 1988 (Cth) (Notifiable Data Breaches scheme). We will take reasonable steps to contain and remediate any breach and will provide you with information about the breach and recommended steps you can take.

9. Limitation of Liability

To the maximum extent permitted by law:

  • The Service is provided "as is" without warranties of any kind, express or implied
  • We do not guarantee that the Service will be uninterrupted, error-free, or that transcriptions will be 100% accurate
  • Our total liability for any claim arising from or related to the Service is limited to the fees you paid in the 12 months preceding the claim
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Australian Consumer Law, including liability for death or personal injury caused by negligence, fraud, or the consumer guarantees under the Competition and Consumer Act 2010 (Cth).

10. Indemnification

You agree to indemnify and hold harmless AI Call Assist Pty Ltd, its directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any applicable law, including call recording laws
  • Any claim by a third party related to calls recorded through the Service

11. Termination

You may cancel your subscription and close your account at any time through the Service settings or by contacting us. Upon termination:

  • Your access to the Service will cease at the end of your current billing period
  • We will delete your data within 30 days, except where retention is required by law
  • No refund will be issued for the remaining portion of a billing period, except where required by Australian Consumer Law

We may terminate or suspend your account immediately if you violate these Terms or if required by law.

12. Force Majeure

We will not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from events beyond our reasonable control, including but not limited to: natural disasters, acts of government, telecommunications failures, power outages, cyberattacks, pandemics, or failures of third-party service providers.

13. Governing Law and Disputes

These Terms are governed by the laws of the Australian Capital Territory, Australia. Any disputes arising from or related to these Terms or the Service will be subject to the exclusive jurisdiction of the courts of the Australian Capital Territory.

Before initiating legal proceedings, you agree to attempt to resolve any dispute through good-faith negotiation within 30 days of written notice to the other party.

14. General Provisions

  • Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and AI Call Assist Pty Ltd regarding the Service and supersede all prior agreements and understandings.
  • Severability: If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect.
  • Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
  • Assignment: We may assign our rights and obligations under these Terms without your consent. You may not assign your rights or obligations without our prior written consent.
  • Notices: We may send you notices via email to the address associated with your account or through in-app notifications. Notices to us should be sent to [email protected].
